Running a nursing home without registration is a criminal offence under the Act (up to 6 months / ₹10,000). Where it applies it is annual, and the registering authority changes with where you are.

Depends on your setup: Registration under the Maharashtra Nursing Homes Registration Act, 1949 is required if you RECEIVE and nurse patients — i.e. you have beds (hospital, nursing home, maternity home). A bed-less out-patient consulting clinic arguably falls outside the Act, but the line is fact-specific and some local bodies register clinics too, so confirm with your local health authority.

You cannot dispense or sell medicines without an FDA drug licence, and it is granted only where a registered pharmacist is in place — so the pharmacist has to be arranged before you plan an in-house dispensary.

A hospital or nursing home in a high-rise or a larger building typically needs it; a small clinic in a compliant low-rise standalone unit may not. A doctor must be registered with the Maharashtra Medical Council (or the relevant council for their system of medicine) to practise — that is a personal professional qualification, separate from every licence here, and running a facility does not substitute for it. Sort your council registration independently.
  • Costly mistake —Bio-medical waste authorisation catches even the smallest clinic. The Bio-Medical Waste Management Rules, 2016 apply irrespective of size or system of medicine — a single-doctor clinic that gives injections or dresses wounds generates bio-medical waste and needs MPCB authorisation. This is the requirement that reaches a bed-less clinic even when the Nursing Homes Act does not, so it is required for everyone in this journey.
  • Costly mistake —Beds are the switch that turns on nursing-home registration, and it is a criminal matter. If you receive and nurse patients on the premises, you need registration under the Maharashtra Nursing Homes Registration Act, 1949 before you open — running an unregistered nursing home carries imprisonment up to six months or a ₹10,000 fine. And it is annual, not one-time.
  • An in-house dispensary needs a registered pharmacist. If you plan to dispense or sell medicines from your own counter, the FDA retail drug licence is granted only where a registered pharmacist is in place — arrange the pharmacist before you build the dispensary, or the licence (and the counter) cannot open.
  • Health-care services are largely GST-exempt, but your non-clinical receipts may not be. Clinical services by a clinical establishment are broadly exempt, yet pharmacy sales, cosmetic or wellness procedures and equipment hire can be taxable — do not assume the whole facility is outside GST because the consultations are. Confirm your mix.
  • Sequence saves repeat visits: Shop & Establishment registration first, then bio-medical waste authorisation and (if bedded) nursing-home registration, with fire feasibility checked up front for a bedded or high-rise premises, and the drug licence started early if you want a dispensary (the pharmacist requirement takes lead time). Local bodies often want fire and BMW documents alongside the nursing-home registration, so line them up together.
