Getting your marriage on the government record in Maharashtra. There are two different laws, two different offices and two different processes — which one you use depends on whether you are registering a marriage that already happened or solemnising a new one. Picking the wrong track is the single most common way couples waste a month.

Who can apply
- Registration of marriages is compulsory in Maharashtra — every marriage in the State must be registered (Section 4 of the 1998 Act), and the Supreme Court held registration compulsory in Seema v. Ashwani Kumar (Transfer Petition 291/05)
- Not registering does not make your marriage invalid — the Act says so explicitly (Section 10 of the 1998 Act). What you lose is proof: without registration there is no government record that the marriage happened, which is what banks, employers, visa officers and insurers actually ask for.
- Under the 1998 Act, the memorandum goes to the Registrar in whose jurisdiction the husband ordinarily resides, or where either party ordinarily resides
- Under the Special Marriage Act track, parties give notice to the Marriage Officer of a district where at least one of them has resided for not less than thirty days immediately preceding the date of the notice/application

The 1998 Act track can complete in a single appearance once the memorandum and three witnesses are lined up; via Aaple Sarkar in rural areas it is an RTS-notified service with a 5-day limit and the Gram Sevak as designated officer. The Special Marriage Act track has a hard floor of 30 days — the notice period is statutory and cannot be shortened.

Common questions
Is registering a marriage compulsory in Maharashtra?
Yes. Every marriage in the State must be registered (Section 4 of the 1998 Act), and the Supreme Court held marriage registration compulsory in Seema v. Ashwani Kumar (Transfer Petition 291/05), as IGR Maharashtra's own page notes.
We didn't register. Is our marriage invalid?
No. A marriage is not invalid solely because it was not registered (Section 10 of the 1998 Act). But you have no government proof it happened — which is what banks, employers, insurers and visa authorities ask for, and what an employer needs before changing your marital status on their records (Section 11).
What's the difference between the two tracks?
If your wedding already happened by religious or traditional rites, you register it under the Maharashtra 1998 Act — a memorandum, three witnesses, at your local body. If you want to marry before a Marriage Officer instead, that's the Special Marriage Act, 1954 — a 30-day notice, then solemnisation, through the Department of Registration & Stamps.

Register anyway. Within one year: a penalty capped at ₹100. After one year: registration is still allowed at any time, with a penalty capped at ₹500. There is no magistrate and no court in this path.
How much does a Special Marriage Act marriage cost?
Per IGR Maharashtra's published fees: ₹100 for the application, ₹150 for solemnisation at the Marriage Registrar's office (₹1,000 at any other venue), and ₹25 for the certificate.
Do I have to change my name after marriage?
No. Nothing in either Act requires anyone to change their name on marriage. If you choose to, the marriage certificate is the document that unlocks it — see the name-change chain.

Aaple Sarkar lists the marriage certificate under the Rural Development and Panchayat Raj Department, with the Gram Sevak as the designated officer and a 5-day time limit under the Right to Public Services Act. Appeals go to the Assistant Block Development Officer, then the Block Development Officer.
