Registration of a birth and the certificate that follows. For anyone born on or after 1 October 2023 the birth certificate is the single document that proves date and place of birth for Aadhaar, passport, school admission, driving licence, voter roll and marriage registration — so this is the first and most important piece of paper your child will ever have.

Who can apply

  • The birth is registered where it occurred — not where you live. A baby delivered in a hospital in another city or district is registered with that local body's Registrar.
  • For a hospital, health centre, maternity or nursing-home birth, the medical officer in-charge (or a person authorised by them) is legally responsible for reporting — not the parents. For a birth at home, the head of the household or the nearest relative present reports it.
  • A child born outside India is registered at the Indian Mission under the Citizenship Act, 1955. If the parents return to India to settle, the birth can be registered within 60 days of the child's arrival at the place of settling (Section 20); beyond that, the delayed-registration route applies.

Common questions

Do I have to register the birth myself if the baby was born in a hospital?

No. For a birth in a hospital, health centre, maternity home or nursing home, the medical officer in-charge or a person authorised by them is responsible for reporting it — the CRS FAQ is explicit that such events are NOT to be reported by the household. Your job is to check that the details they file are correct and to collect the certificate.

Why does the birth certificate suddenly matter so much?

For anyone born on or after 1 October 2023, the birth certificate is mandatory to prove date and place of birth for: admission to an educational institution, a driving licence, the voter list, registration of a marriage, appointment to a government/PSU post, a passport, and an Aadhaar number. It is the root document of the whole chain.

What if we missed the 21 days?

You can still register. Within 30 days: pay the prescribed late fee. After 30 days but within a year: you need written permission from the prescribed authority, the prescribed fee, and an affidavit before a notary public. After a year: only on the order of a first-class magistrate who verifies the birth.

The certificate has no name on it — is that a problem?

Yes, downstream. A birth can be registered without a name, and the name can then be entered free within 12 months of registration and on payment of a fee for up to 15 years (Section 14). Get it done: Aadhaar, passport and schools will not accept a blank-name certificate.

How many copies do I get?

One free copy to the informant under Section 12. Any number of further copies to anyone under Section 17 on payment of the prescribed fee.

Our child was born abroad and we are moving back to India. What then?

The birth is registered at the Indian Mission under the Citizenship Act, 1955 and the Citizens (Registration at Indian Consulates) Rules, 1956. If you return to India to settle, you can register the birth within 60 days of the child's arrival at the place of settling (Section 20 of the RBD Act); after that, the delayed-registration provisions apply.

We're in a village — how long should this take?

Aaple Sarkar lists the birth certificate with a 5-day time limit and the Gram Sevak as designated officer, under the Right to Public Services Act. If it slips, first appeal goes to the Assistant Block Development Officer and second appeal to the Block Development Officer.
